AN ACT
RELATING TO CRIME; PROVIDING FOR A VICTIM'S RECOVERY WHEN THE VICTIM IS INCARCERATED AT THE TIME OF THE CRIME.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. Section 31-22-11 NMSA 1978 (being Laws 1981, Chapter 325, Section 11) is amended to read:
"31-22-11. [NO] AWARD TO [CERTAIN CONFINED] PERSONS WHO ARE VICTIMIZED WHILE INCARCERATED.--[No award shall be made] A person who is a victim of an enumerated crime while that person is incarcerated in a county or municipal jail, penitentiary or other correctional facility may apply for compensation pursuant to the [provisions of the] Crime Victims Reparation Act [to a victim injured while confined in a county or municipal jail, penitentiary or other correctional facility] after the person is released from incarceration."
