AN ACT

RELATING TO HEALTH; ENACTING A NEW SECTION OF CHAPTER 21 NMSA 1978 TO REQUIRE PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS TO PROVIDE FREE CONDOMS TO STUDENTS; ENACTING A NEW SECTION OF THE PUBLIC SCHOOL CODE TO REQUIRE SCHOOL DISTRICTS TO PROVIDE FREE CONDOMS TO PUBLIC SECONDARY SCHOOL STUDENTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 21 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] FREE CONDOMS AVAILABLE FOR STUDENTS IN PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS.--Public post-secondary educational institutions shall make condoms available to all students, free of charge. Institution administrators, in consultation with student health centers and other entities that provide services to students, shall determine the best manner in which to make condoms available to students. At a minimum, condoms shall be placed in locations that are safe and readily accessible to students, including student health centers and restrooms."

     SECTION 2. A new section of the Public School Code is enacted to read:

     "[NEW MATERIAL] FREE CONDOMS AVAILABLE FOR STUDENTS IN PUBLIC SECONDARY SCHOOLS.--Local school boards and governing bodies of charter schools shall adopt policies to make condoms available for high school students, free of charge. Public school administrators, in consultation with school nurses, shall determine the best manner in which to make condoms available to students. At a minimum, condoms shall be placed in locations that are safe and readily accessible to students, including the school nurse's office and restrooms."
