A JOINT MEMORIAL

REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO CREATE A SPECIAL INTERIM COMMITTEE DEDICATED TO EXAMINING ISSUES PRESENTED BY ARTIFICIAL INTELLIGENCE TECHNOLOGY AND DEVELOPING LEGISLATIVE PROPOSALS FOR THE REGULATION OF THE TECHNOLOGY AND THE PROTECTION OF DATA PRIVACY.

 

     WHEREAS, artificial intelligence is rapidly transforming industries, government operations, health care, education and daily life, offering significant economic and social benefits while also raising concerns regarding bias, security, transparency, workforce displacement and ethical implications; and

     WHEREAS, the collection, use and sharing of personal data have become increasingly complex, leading to growing concerns about consumer privacy, data security, digital rights and the potential for misuse of personal information by private and public entities; and

     WHEREAS, the absence of comprehensive data privacy laws in New Mexico places residents at risk of unauthorized data collection, breaches and exploitation, and businesses lack clear regulatory guidance on responsible data practices; and

     WHEREAS, several states have enacted or are considering comprehensive data-privacy- and artificial-intelligence-related legislation, and New Mexico must evaluate these developments to ensure its policies align with national and global best practices while reflecting the state's unique needs; and

     WHEREAS, New Mexico is home to national laboratories, research institutions and a growing technology sector; and

     WHEREAS, because of the state's technology sector, it is critical for the state to proactively engage in artificial intelligence and data privacy policy discussions to foster responsible innovation and economic growth; and

     WHEREAS, artificial intelligence and data privacy regulations impact numerous stakeholders, including businesses, consumers, educators, health care providers and government agencies, necessitating a broad and inclusive approach to policymaking; and

     WHEREAS, the establishment of a special legislative committee would provide a structured forum for experts, industry leaders, public interest groups and community members to offer insights and ensure that artificial intelligence and data privacy policies are well-informed and effectively address potential risks and opportunities;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the New Mexico legislative council be requested to create a special interim legislative committee during the 2025 interim to hold hearings, gather testimony from stakeholders and develop recommendations for legislation in the 2026 legislative session that addresses artificial intelligence development, deployment and regulation, as well as comprehensive data privacy protections for New Mexico residents; and

     BE IT FURTHER RESOLVED that the special interim legislative committee be requested to discuss artificial intelligence and comprehensive data privacy legislation, including an examination of existing and proposed federal, state and international approaches to artificial intelligence governance and data protection; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the governor, the director of the legislative council service, the New Mexico legislative council, the secretary of information technology, the directors of New Mexico's national laboratories, the presidents or chancellors of the state's post-secondary educational institutions, representatives of the state's technology businesses and relevant consumer advocacy and business organizations.
