AN ACT

RELATING TO THE ENVIRONMENT; PROHIBITING THE ADOPTION OF CERTAIN RULES RELATING TO THE PRODUCTION AND DELIVERY FOR SALE OF ZERO-EMISSION VEHICLES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Air Quality Control Act is enacted to read:

     "[NEW MATERIAL] RESTRICTING PROVISIONS OF LAW RELATING TO THE PRODUCTION AND DELIVERY FOR SALE OF ZERO-EMISSION VEHICLES.--A provision of the Air Quality Control Act shall not be interpreted to provide a state agency, the department, the environmental improvement board, a local board, a local agency or a county or municipality that has assumed jurisdiction for local administration and enforcement of the Air Quality Control Act pursuant to Section 74-2-4 NMSA 1978 with the authority to adopt or continue in effect a rule that:

          A. restricts, limits or prohibits the delivery, use, lease, sale or purchase of a vehicle by a business, corporation or person based on the energy source used to power the vehicle, including the energy source used for propulsion or use of powering other functions of the vehicle;

          B. restricts, limits or prohibits the delivery, use, lease, sale or purchase of a new vehicle with an internal combustion engine by a business, corporation or person; or

          C. establishes a percentage or proportion of vehicles that must be delivered, used, leased, sold or purchased by a business, corporation or person based on the energy source used to power the vehicle."
