AN ACT

RELATING TO PUBLIC SCHOOLS; REQUIRING THE PUBLIC EDUCATION DEPARTMENT TO PUBLISH THE RESULTS OF THE DEPARTMENT-APPROVED SUMMATIVE ASSESSMENTS FOR SCIENCE, MATHEMATICS AND ENGLISH LANGUAGE ARTS; ESTABLISHING A DEADLINE FOR PUBLICATION; REQUIRING REPORTING ON SPECIFIC PERFORMANCE AND TREND DATA; REQUIRING USER-FRIENDLY PUBLICATION ACCESS; ASSIGNING DUTIES TO THE PUBLIC EDUCATION DEPARTMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Assessment and Accountability Act, Section 22-2C-14 NMSA 1978, is enacted to read:

     "22-2C-14. [NEW MATERIAL] SUMMATIVE ASSESSMENTS--PUBLICATION DEADLINE--REQUIREMENTS--PERFORMANCE AND TRENDS.--For the purposes of this section, "summative assessment" means a department-approved assessment that is a single measure of student performance at the end of a grade band. The department shall publish the results of the summative assessments for science, mathematics and English language arts. In publishing these summative assessment results, the department shall:

          A. publish the results provided for in this section no later than September 1 of each calendar year;

B. at a minimum, include the following data:

                (1) the overall statewide performance and trends for students across all grade levels; and

                (2) subgroup performance data that is disaggregated by student demographics and is broken down by grade level, including:

                     (a) race;

                     (b) ethnicity;

                     (c) socioeconomic status;

                     (d) special education status; and

                     (e) performance data broken down by grade and subject for each school; and

          C. publish the results in an easily accessible, user-friendly format through a website or web page managed and regularly maintained by the department and provide links to the website or web page on the home page of the department's primary website."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2025.
