AN ACT

RELATING TO CANNABIS; ALLOWING COUNTIES TO PETITION THE CANNABIS CONTROL DIVISION OF THE REGULATION AND LICENSING DEPARTMENT FOR A MORATORIUM ON NEW CANNABIS PRODUCER LICENSES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Cannabis Regulation Act is enacted to read:

     "[NEW MATERIAL] NEW CANNABIS PRODUCER LICENSE MORATORIUM--COUNTY PETITION.--

          A. A board of county commissioners may vote to petition the division to impose a two-year moratorium on the issuance of new cannabis producer licenses in that county and shall publish a public notice of its petition and notify the division. The petition may cover commercial cannabis production only or both commercial and medical cannabis production.

          B. The county shall submit the petition to the division within ten days of approving the petition. The division shall render its decision on the petition within ten days of receipt of the petition and inform the county of its decision to approve or deny the petition. If the division approves the petition, it shall not issue new cannabis production licenses for the two-year period of the moratorium. If the division denies the petition, it shall include its findings and conclusions in the order of denial.

          C. The county may petition the division to end the moratorium before the two-year period has run if the county commission determines that the moratorium is no longer necessary."
